THESE TERMS OF SERVICE CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER (SECTION 20) THAT GOVERN HOW DISPUTES BETWEEN YOU AND ADVANCED FINANCIAL COMPANY ARE RESOLVED. PLEASE READ THEM CAREFULLY.
1. ACCEPTANCE OF TERMS AND CONDITIONS
These Terms of Service (these “Terms” or this “Agreement”) constitute a legally binding contract between Advanced Financial Company, a California corporation (“AFC,” “we,” “us,” or “our”), and you, whether personally or on behalf of an entity (“you,” “your,” or “User”), concerning your access to and use of the AFC website located at “advancedfinco.com” and any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Website”).
By accessing, browsing, creating an account on, or utilizing the payment processing and account servicing tools available via the Website, including but not limited to any digital interfaces, payment portals, interactive voice response systems, and financial servicing applications operated by AFC (collectively, the “Services”), you expressly acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Website and Services, and you must discontinue use immediately.
2. AMENDMENTS AND MODIFICATIONS
AFC reserves the right, in its sole and absolute discretion, to alter, amend, modify, update, or replace these Terms at any time and for any reason. We will alert you to changes by updating the “Last Updated” date of these Terms. Any and all modifications or amendments will become effective immediately upon posting to the Website. Your continued use of the Website or Services following the posting of revised Terms signifies your explicit acceptance of, and agreement to be bound by, the amended Terms. It is your sole responsibility to review these Terms periodically to remain informed of updates.
3. GEOGRAPHIC RESTRICTIONS AND ELIGIBILITY
The Website and Services are controlled, operated, and administered by AFC from its offices within the United States of America. The Website and Services are intended solely for residents of the United States and Canada who are eighteen years of age or older, or the age of majority in their respective jurisdiction of residence.
The Website and Services are not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to local law or regulation, or which would subject AFC to any registration or compliance requirements within such jurisdiction. Specifically, AFC does not target, market to, offer goods or services to, or intentionally monitor the behavior of data subjects located within the European Union (EU), the European Economic Area (EEA), the United Kingdom (UK), or any other jurisdiction outside the United States and Canada. If you access the Website or Services from outside the United States or Canada, you do so at your own risk and are solely responsible for compliance with all local laws.
4. PRIVACY POLICY INCORPORATION BY REFERENCE
Your use of the Website and Services is also governed by AFC’s Privacy Policy, which is located at www.advancedfinco.com/privacy_policy.aspx. By agreeing to these Terms, you acknowledge that you have reviewed and agree to the terms of the Privacy Policy.
5. AFC’S ROLE AS A THIRD-PARTY SERVICER
You acknowledge and agree that AFC is a third-party financial servicing company and/or payment processor acting on behalf of third-party creditors, homeowners’ associations, timeshare associations, or fractional property associations (each, an “Association”). AFC does not own, manage, maintain, or control the underlying properties, products, or services provided by your Association. AFC is not a party to any underlying contract, covenant, declaration, or agreement between you and your Association. Any dispute regarding the calculation of balances, underlying fees, fines, assessments, association rules, or property management performance must be resolved directly with your Association, and you shall not withhold payment from AFC or assert any such defense or counter-claim against AFC. Nothing in this Section limits any rights or defenses you may have under applicable federal or state law, including any rights preserved under the FTC’s Preservation of Consumers’ Claims and Defenses Rule (16 C.F.R. § 433) or equivalent state statutes.
6. ELECTRONIC SIGNATURES AND ELECTRONIC DISCLOSURES (E-SIGN CONSENT)
By utilizing the Services, you consent to receive all communications, agreements, disclosures, statements, payment histories, notices, and receipts (collectively, “Communications”) from AFC electronically. You agree that all electronic Communications satisfy any legal requirement that such communications be in writing.
To access and retain electronic Communications, you must possess:
- A device with an internet connection;
- A current web browser with cookies enabled;
- A valid email address registered with AFC; and
- Sufficient storage space or a printer to save or print Communications.
You may withdraw your consent to receive electronic Communications at any time by contacting us in writing at the address set forth in Section 23. However, withdrawal of your E-Sign consent may result in the immediate termination of your access to the online Services.
7. PAYMENT BY CREDIT CARD/DEBIT CARD
If you elect to submit a payment using a credit card or debit card, you must utilize a card issued by a financial institution located in the United States (“U.S. Bank”) or Canada (“CN Bank”), as applicable under Section 9.
Authorization: Each time you initiate a transaction, you expressly authorize AFC (or our designated third-party payment gateway) to charge your designated credit or debit card account for the full principal, interest, late fees, and any applicable convenience or processing fees.
Declined Transactions: If AFC does not receive immediate authorization from your card issuer, the transaction will be deemed null and void, and your underlying account balance with the Association will remain unpaid and subject to late fees. AFC assumes no liability for failed transactions.
Third-Party Fees: Your relationship with your card issuer governs your use of the card. You acknowledge that your issuer may impose separate transaction fees, cash advance fees, or foreign currency conversion fees, for which you are solely responsible.
8. PAYMENT BY ELECTRONIC CHECK/ACH
You may authorize AFC to initiate electronic fund transfers via the Automated Clearing House (“ACH”) network from a checking or savings account held in your name at a financial institution located in the United States (“U.S. Bank Account”).
ACH Authorization: By submitting your routing and account numbers, you grant AFC a continuous authorization to initiate electronic debits from your U.S. Bank Account in the amounts selected by you, and to initiate electronic credits or adjustments to correct any erroneous transactions.
NACHA Rules: All ACH transactions must comply with all applicable U.S. laws and the Operating Rules of the National Automated Clearing House Association (“NACHA”).
Revocation: You may revoke ACH authorization only by providing written notice to AFC at least three (3) business days prior to a scheduled debit date. AFC will endeavor to act on revocation requests received after this deadline on a commercially reasonable basis, but cannot guarantee cancellation of an imminent debit.
NSF and Dishonored Rules: If any ACH debit is returned unpaid due to non-sufficient funds (“NSF”), account closure, or incorrect information, AFC reserves the right to charge an administrative return fee up to the maximum amount permitted by applicable law, and your account will be deemed delinquent.
9. CANADIAN CUSTOMERS AND CURRENCY SPECIFICS
If your assigned account with an Association is structurally located within Canada, you may submit payments using a credit card or bank account issued by a financial institution located in Canada (“CN Bank”).
Currency of Account: Payments must be made in the currency designated by your Association. If you attempt to submit a payment in a currency other than the national currency of the country in which your Association account is domiciled, AFC may, in its sole discretion, reject the payment or apply a commercially reasonable currency conversion spread and administrative fee.
Cross-Border Transactions: You acknowledge that international credit card transactions may be subject to cross-border assessment fees by card networks (Visa, MasterCard, Amex, Discover), which will be passed through to you or added to the transaction total.
10. REFUND POLICY AND REVERSAL DISPUTES
All payments processed through the Website are final. Payments are applied to your outstanding Association balance in strict accordance with the terms of your Association’s specific governing documents (e.g., financing agreement, CC&Rs, Bylaws, Rules, etc.…).
Overpayment Refund Requests: If you believe you have overpaid your balance, a request for a refund must be submitted in writing within thirty days of the transaction to:
Advanced Financial Company
Attn: Refund Department
5900 Pasteur Court, Suite 210
Carlsbad, CA 92008
Required Documentation: Your written refund request must include your full legal name, AFC account number, permanent physical address, current contact information, the exact transaction date/amount, and documentary proof of the alleged overpayment.
Chargebacks and Reversals: You agree not to initiate frivolous credit card chargebacks or ACH payment reversals. If you initiate a chargeback dispute that is found to be invalid, you agree to reimburse AFC for all administrative costs, network fees, and reasonable attorneys’ fees incurred in defending the dispute.
11. TRANSACTION DOCUMENTATION AND POSTING TIMELINES
Statements: Your bank or credit card statement will typically reflect payments processed via the Website under the name of AFC or the designated Association client name.
Posting Schedule: Payments submitted through the Website are generally processed and posted to your internal AFC account ledger within approximately three business days (Monday through Friday, excluding U.S. federal and banking holidays).
Record Retention: A transactional payment history will be made available to you via the Website’s user portal on the business day following successful processing. You are solely responsible for downloading, printing, and retaining copies of your transaction records for your personal files.
12. COMMUNICATIONS AND TEXT MESSAGE (SMS) POLICY
By providing your wireless/cellular telephone number to AFC, you explicitly provide your prior express written consent to receive autodialed, pre-recorded, and/or artificial voice calls, as well as Short Message Service (SMS) text messages from AFC, its parents, subsidiaries, affiliates, agents, employees, attorneys, subsequent creditors, loan servicing companies, and third-party debt collectors. Your consent to receive autodialed communications is transferable to any entity that acquires AFC’s rights or obligations under this Agreement or under your underlying account, to the extent permitted by applicable law.
Scope of Messages: These communications may include, but are not limited to, transactional confirmations, account alerts, payment due date reminders, delinquency warnings, and lawful collection attempts.
Carrier Rates: Your wireless carrier’s standard Message and Data Rates apply to all confirmation messages and subsequent texts. AFC is not responsible for any costs incurred by you.
Third-Party Exposure: You acknowledge that text messages sent to your mobile device are unencrypted and may be visible to anyone who has physical or digital access to your device. You agree to safeguard your phone to maintain privacy. YOU AGREE NOT TO TRANSMIT SENSITIVE PERSONAL IDENTIFIABLE INFORMATION OR CONFIDENTIAL FINANCIAL DATA TO AFC VIA RETURN SMS.
Opt-Out (STOP): You may opt out of receiving SMS marketing or transactional messages at any time. To cease marketing texts, reply STOP to any text message received. To cease all text messages (including critical payment reminders and debt collection notices), reply STOP ALL. Your opt-out request will be processed and become effective within a reasonable operational timeframe (typically within one (1) business day). You may also opt out by calling 1-800-234-6222 or emailing customercare@advancedfinco.com.
Help (HELP): For assistance or contact information, reply HELP to any text message received, and an automated informational message will be generated.
Limitation on Volume: AFC will use reasonable efforts to limit routine informational text messages; however, this limit does not apply to urgent collection communications or individual responses to inquiries initiated by you.
Number Updates: You agree to notify AFC immediately in writing or via the user portal if you change, deactivate, or transfer your mobile number to another individual.
13. USER REPRESENTATIONS, WARRANTIES, AND RELIANCE
You represent, warrant, and covenant to AFC that:
- All information provided by you in connection with your account registration and transactions is truthful, accurate, current, and complete;
- You are the lawful owner or authorized signatory of the credit card, debit card, or U.S./Canadian Bank Account utilized for any transaction;
- You have the full legal capacity and contractual authority to enter into these Terms; and
- Your use of the Website and Services will not violate any applicable federal, state, provincial, or local law or regulation.
AFC Reliance: You agree that AFC is fully entitled to rely solely and exclusively upon the information, account numbers, routing numbers, and credentials provided by you without undertaking any independent investigation. AFC assumes no responsibility or liability for processing errors, misdirected funds, or late penalties resulting from incorrect, fraudulent, or typo-ridden data entered by you.
14. USER ACCOUNT SECURITY AND CREDENTIALS
If you create an account or online profile on the Website, you are entirely responsible for maintaining the strict confidentiality of your username, password, security questions, and any other authentication credentials. You agree not to disclose your login credentials to any third party. You are fully responsible for all activities, transactions, and financial liabilities incurred under your account. You agree to notify AFC immediately at customercare@advancedfinco.com or 1-800-234-6222 if you suspect or become aware of any unauthorized use of your account, loss of credentials, or any other breach of security.
15. INTELLECTUAL PROPERTY RIGHTS

18. LIMITATION OF LIABILITY
IN NO EVENT SHALL AFC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, OR COST OF SUBSTITUTE SERVICES, ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE WEBSITE OR SERVICES, EVEN IF AFC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, THE CUMULATIVE, AGGREGATE LIABILITY OF AFC TO YOU FOR ANY CLAIMS WHATSOEVER ARISING OUT OF OR RELATED TO THIS AGREEMENT, THE WEBSITE, OR THE SERVICES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR BREACH OF STATUTORY DUTY, SHALL AT ALL TIMES BE LIMITED TO AND SHALL NOT EXCEED THE TOTAL SUM OF FIVE HUNDRED DOLLARS ($500.00 USD). SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
19. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless AFC, its parent companies, subsidiaries, affiliates, and all of their respective directors, officers, employees, owners, agents, licensors, licensees, successors, and third-party service providers (collectively, the “Indemnified Parties”) from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind (including, without limitation, reasonable attorneys’ fees, expert witness fees, and the costs of enforcing any right to indemnification hereunder) incurred by or asserted against the Indemnified Parties arising out of or resulting from:
- Your access to, use of, or misuse of the Website or Services;
- Any transaction information, electronic check routing data, or text data you transmit to AFC;
- Your breach or alleged breach of any representation, warranty, or covenant contained in these Terms;
- Your violation of any applicable federal, state, provincial, or local law or regulation; or
- Your infringement or violation of the intellectual property, privacy, or publicity rights of any third party.
AFC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate fully with AFC’s defense of such claims. You shall not settle or compromise any claim subject to this Section without the prior express written consent of AFC.
20. BINDING ARBITRATION AND CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Mandatory Binding Arbitration: Except for disputes that qualify for small claims court or claims seeking emergency injunctive relief, all disputes, claims, or controversies arising out of or relating to these Terms, the Website, the Services, your relationship with AFC, or the breach, termination, enforcement, interpretation, or validity of this Agreement (collectively, “Disputes”) shall be resolved exclusively through final, binding, and individual arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted before a single neutral arbitrator. AFC will pay all AAA administrative fees and arbitrator fees in excess of the consumer filing fee required under the AAA Consumer Arbitration Rules.
Waiver of Jury Trial: You and AFC hereby explicitly waive any constitutional or statutory right to a trial by jury in a court of law. The arbitrator’s decision will be final and binding, and judgment upon the award rendered by the arbitrator may be entered in any court having competent jurisdiction.
Class Action Waiver: YOU AND AFC EXPLICITLY AGREE THAT ALL CLAIMS AND DISPUTES MUST BE ARBITRATED OR LITIGATED STRICTLY ON AN INDIVIDUAL BASIS, AND NOT ON A CLASS, COLLECTIVE, COORDINATED, REPRESENTATIVE, OR CONSOLIDATED BASIS. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a class or representative proceeding. If this specific class action waiver paragraph is determined to be illegal or unenforceable as to all or some parts of a Dispute, then this entire Section 20 (Arbitration) shall be null and void, and those components of the Dispute shall be severed and proceed exclusively in a court of competent jurisdiction. Notwithstanding any other provision of this Agreement, nothing herein shall be construed to waive any right to seek public injunctive relief in a court of competent jurisdiction to the extent such right cannot be waived under applicable law in the applicable jurisdiction associated with any dispute.
Venue and Governing Law: The arbitration shall take place in San Diego County, California, unless you and AFC mutually agree otherwise in writing. The arbitrator shall apply the substantive laws of the State of California, without regard to its conflict of laws principles.
Opt-Out Procedure: You have the right to opt out of this binding arbitration provision within thirty days from the date you first accept these Terms. To opt out, you must mail a physical written notice containing your full name, account number, and an unequivocal statement that you decline arbitration to: Advanced Financial Company, Attn: Legal Department, 5900 Pasteur Court, Suite 210, Carlsbad, CA 92008. If you opt out, Disputes will be resolved in court pursuant to Section 21.
21. GOVERNING LAW, FORUM SELECTION, AND VENUE
These Terms and all aspects of your relationship with AFC shall be governed by, interpreted, and construed in accordance with the internal laws of the State of California, without reference to its conflict of laws principles, and the Federal Arbitration Act (FAA) shall govern all arbitration provisions. To the extent any Dispute is permitted to proceed in a court of law (including any small claims matters or if you timely opt out of arbitration), you and AFC hereby consent to the exclusive personal jurisdiction and venue of the state and federal courts located in San Diego County, California.
22. ADDITIONAL TERMS
Entire Agreement: These Terms, together with any applicable Association enrollment agreements or E-Sign forms completed by you, constitute the entire agreement between you and AFC regarding your use of the Website and Services, superseding any prior written or oral agreements or understandings.
Severability: If any provision or part of a provision of these Terms is determined by a court or arbitrator of competent jurisdiction to be unlawful, void, or unenforceable, that specific provision shall be deemed severed from this Agreement, and its invalidity shall not affect the validity, legality, and enforceability of the remaining provisions.
No Waiver: A failure or delay by AFC to exercise or enforce any right, power, or remedy under these Terms shall not operate or be construed as a waiver of such right, power, or remedy, nor shall any single or partial exercise preclude any further exercise thereof.
Assignment: AFC may assign, transfer, or delegate any or all of its rights and obligations under these Terms to a third party at any time without notice or your consent. You may not assign or transfer your rights or obligations under these Terms without AFC’s prior express written authorization.
Survival: All sections of these Terms which by their inherent nature should survive the termination or expiration of this Agreement shall survive, including, without limitation, Sections 5, 10, 13, 15, 17, 18, 19, 20, 21, and 22.
